Today, 8 November 2019, I received a telephone call from  a PS of Gwent police with reference to a statement made by me for Avon and Somerset police on 18 October 2019 but which was not forwarded to that force by a PC  Was as agreed at the time and in the presence of a witness. She and her Sergeant PS subsequently decided without my knowledge or agreement to retain my statement and close the report as NFA (No Further Action). I was not made aware of this until today on receipt of a telephone call from Avon and Somerset received before the call from the PS  informed me that Gwent police will not action or record any complaint I may make. I contribute to the police precept and therefore am entitled to service from any appropriate police force.

 

 

 

1.         Please confirm and provide a copy of the relevant legislation/Home Office instruction, policy, procedure and/or requirement placed upon Gwent police which permits them to sabotage, interfere with, intercept and refuse to submit my statement so that Avon and Somerset are not in a position to investigate an offence committed in their force area.

 

2.         Please also confirm and provide a copy of the Home Office document(s) which authorise such caveats placed on Home Office Counting Rules to the detriment of a person reporting crime

 

 

 

 

Answer

 

Two duties are placed on public authorities under Section 1 of the Freedom of Information Act 2000 (FOIA). Notwithstanding applicable exemptions, the first duty at, Section 1(1) (a), is to confirm or deny whether the information specified in a request is held. The second duty at, Section1 (1) (b), is to disclose information that has been confirmed as being held. Under the provisions of those sections of the FOIA, we can confirm that the information you seek is not held by the Office of the Police and Crime Commissioner for Gwent.
