1) Please, can you provide a list of all employee roles who are employed by your authority and are subject to the provisions as set out in the Official Secrets Acts 1911-1989?

 

This can be provided in any format, however, a spreadsheet detailing each role and a mark as to whether the role requires the role holder to sign a declaration as to their recognition of being bound thus required to comply with the Act(s).

 

 

 

2) Please provide a disclosure of the format used by your authority which requires the signature of any role holder who is subject to provisions as set out in the Official Secrets Acts 1911-1989 such as an "Official Secrets Acts & Confidentiality Declaration"

 

 

 

 

Answer

 

Two duties are placed on public authorities under Section 1 of the Freedom of Information Act 2000 (FOIA). Notwithstanding applicable exemptions, the first duty at, Section 1(1) (a), is to confirm or deny whether the information specified in a request is held. The second duty at, Section1 (1) (b), is to disclose information that has been confirmed as being held. Under the provisions of those sections of the FOIA, we can confirm that the information you seek is held by the Office of the Police and Crime Commissioner for Gwent. All staff on the list are required to either sign a form entitled ‘Security/Confidentiality Declaration’ or have had reference to the Official Secrets Act included within their Terms and Conditions of appointment.

 

 

 

The Police and Crime Commissioner and Deputy Police and Crime Commissioner also sign a form entitled ‘Official Secrets Act 1989: Notification Notice’.
