Legal Work Generated in Wales given to Counsel based outside Wales

The Circuit would be grateful to receive the following information from the relevant department of your authority in respect of each of the financial years ending 2013, 2014 and 2015:
Question 1: The number of cases across all practice areas in which you instructed off circuit counsel
Question 2: In relation to each case that required attendance at court by off-circuit counsel, what fee was paid to counsel, and whether the fee was in accordance with the consortium rates for Local Authorities (where relevant), or whether it was above or below such fee structures
Question 3: The amount of travel expenses paid to counsel in each such case
Question 4: The amount of overnight accommodation/subsistence allowance or other incidental costs paid to counsel in each such case
Question 5: Whether there was a specific reason in each such case for not instructing counsel based on the Circuit
Question 6: The number of cases in which off-circuit counsel was instructed to provide advice, but was not required to attend at court. In respect of each such case, please indicated the fees paid to counsel, and why it was considered necessary to instruct off-circuit counsel.
Question 7: Would you also please confirm if your authority or legal department has a written policy as to the instruction of counsel who are not based on Circuit. If so, would you kindly provide a copy of the policy.

5. The QC appointed is widely thought of as being the best in his field which is why he was approached.
Fees paid to counsel = £18,262.50
Off-circuit counsel was appointed as per the response to question 5.
7. No policy is held within the Office of the Police and Crime Commissioner (OPCC) for Gwent in relation to the instruction of counsel.
The OPCC also appoints the Chair of any Police Appeals Tribunal. I have not included this information within the response to your request as we are required to appoint from a list of legally qualified Chairs held by the Home Office. There is no one from Wales on this list.
